PRIVACY AND COOKIES POLICY

This Privacy and Cookies Policy contains information about the purposes and methods of processing, as well as the security of your personal data as a User of the glowicewielowrzecionowe.pl website (hereinafter referred to as the Website). By reading the Privacy and Cookies Policy, you will learn who the controller of your personal data is, what personal data is collected by the Website, for what purposes it is used and how it is protected.

§1.
Basic information

1. The owner of the Website and, at the same time, the controller of personal data, hereinafter referred to as the “Controller”, is: Accurate Group Sp. z o.o., with its registered office in Toruń at 13 Wschodnia Street, KRS number 0000299241, NIP 8792547214.

§2.
Definitions

1. GDPR – means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
2. Services – services provided electronically to Users through the Website.
3. User – a person using the Website.

§3.
Data processing principles

1. Personal data collected by the Controller through the Website is processed in accordance with the GDPR.
2. The Controller exercises particular care to respect the privacy of Users visiting the Website.
3. The Controller processes personal data in accordance with the following principles:

a) on a legal basis and in accordance with the law (lawfulness),
b) fairly and honestly (fairness),
c) in a manner transparent to the data subject (transparency),
d) for specific purposes and not “just in case” (minimisation),
e) no more than is necessary (adequacy),
f) with due care for data accuracy (accuracy),
g) no longer than necessary (storage limitation),
h) ensuring appropriate data security (security).

 

§4.
Purposes, legal bases and scope of data processing

1. We will process your data:

a) in order to contact you and respond to a User’s message sent to us by e-mail or through the contact form, pursuant to Article 6(1)(b) and (f) of the GDPR, i.e. for the pursuit of the Controller’s legitimate interest connected with the need to respond to you;
b) for the performance of a contract, in order to respond to a User’s message sent by e-mail or through the contact form on the Website for the purpose of performing an electronically provided service contract. Legal basis: necessity for the performance of the contract for the provision of the contact form service (Article 6(1)(b) of the GDPR);
c) for technical purposes using cookies (technical cookies), pursuant to Article 6(1)(f) of the GDPR, i.e. for the pursuit of the Controller’s legitimate interest connected with the proper operation and functioning of the Website.

2. When using the contact form service on the subpage https:// glowicewielowrzecionowe.pl/kontakt/, the User provides the following ordinary personal data:

• first name,
• their e-mail address,
• telephone number.

3. When using the Website, additional information may be collected, in particular: the IP address assigned to the User’s computer or the external IP address of the Internet service provider, domain name, browser type, access time and operating system type.

4. Navigation data may also be collected from Users, including information about links and references they choose to click or other activities undertaken on the Website. Legal basis – legitimate interest (Article 6(1)(f) of the GDPR), consisting in facilitating the use of electronically provided services and improving the functionality of these services.
5. The remaining data processed by the Controller is data stored in cookies. The User may decide to what extent we may use cookies containing their data. Providing us with data in this manner is voluntary. The User may change their preferences at any time; this can be done in their web browser or by deleting cookies saved by the Website.
6. If you like or otherwise join our social media profile (e.g. Facebook), we will process the data you have provided on the relevant platform managed by the Controller. To end the processing, you may unsubscribe from our profile.
7. External partners’ APIs: the Website may use APIs (application programming interfaces) provided by external partners in order to integrate various functionalities, such as maps, analytics services, advertising services or social media. The use of these APIs may result in the creation of additional cookies or the use of existing cookies for processing Users’ data. External partners may store and process this data in accordance with their own privacy policies.
8. The Controller may collect Users’ IP addresses. An IP address is a number assigned to the User’s computer by an Internet service provider. The IP number enables access to the Internet. In most cases, it is assigned to the computer dynamically, i.e. it changes each time a connection to the Internet is established and, for this reason, is commonly treated as non-personally identifiable information. The IP address is used by the Controller to diagnose technical problems with the server, create statistical analyses (e.g. determine the regions from which the highest number of visits is recorded), as information useful for administering and improving the Website, as well as for security purposes and for the possible identification of unwanted automated programs browsing the Website’s content and placing a load on the server.

 

§5.
Data recipients and possible transfers of data to countries outside the EEA or international organisations.

1. The recipients of Users’ personal data are:

a) entities authorised to obtain personal data under applicable law;
b) entities providing services to the Controller with which the Controller has concluded a personal data processing agreement;

In connection with the Controller maintaining accounts on social media platforms (Facebook, YouTube), Users’ personal data is transferred to Meta Platforms Ireland Limited and may be transferred to the USA. We use Facebook analytics and marketing tools, such as Facebook Pixel, to display personalised advertisements to the User on Facebook. This involves the use of Facebook cookies. Information about the principles of data processing and the possibility for Users who are natural persons to exercise their rights under the GDPR is available at: https://www.facebook.com/privacy/explanation. By consenting to the use of cookies on the Website, the User also consents to the use of these Facebook cookies in their case.
3. Users’ personal data may be transferred to service providers used by the Controller, including in connection with operating the Website. These include, among others, providers of hosting services, accounting services, marketing systems, Website traffic analysis systems and systems for analysing the effectiveness of marketing campaigns. Depending on contractual arrangements and circumstances, service providers to whom personal data is transferred either act on the Controller’s instructions regarding the purposes and methods of processing such data (processors) or independently determine the purposes and methods of processing the data (controllers).
4. The Website uses Google Analytics tools provided by Google LLC, with its registered office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Using cookies, these tools collect information concerning Users’ visits to the Website, mainly including: anonymised IP addresses, visitor identifiers, subpages visited by the User, time spent on the Website, navigation between individual subpages, demographic data and interest data. The collected data is aggregated and stored on Google LLC servers in the USA. You may block Google Analytics cookie functions at any time by installing the Google Analytics opt-out browser add-on available at: https://tools.google.com/dlpage/gaoptout.
5. For the purpose of conducting advertising campaigns, we use the Google Ads tool, which uses its own cookies belonging to the above-mentioned company Google LLC. By consenting to the use of cookies on the Website, you also consent to the use of Google Ads cookies in your case.
6. We use Google Tag Manager software, which helps us collect analytical data, control advertising campaigns and analyse how Users use the Website. This tool uses its own scripts and cookies.
7. If a request is submitted, the Controller has the right and may be required to disclose personal data to authorised state authorities, in particular organisational units of the Public Prosecutor’s Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

 

§6.
Data processing period

1. Personal data collected on the basis of consent is processed until the consent is withdrawn. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of the consent before its withdrawal.
2. Users’ personal data is stored:

2.1. Where the basis for processing personal data is consent, Users’ personal data is stored by the Controller until the consent is withdrawn and, after its withdrawal, for a period corresponding to the limitation period for claims that may be raised by the Controller and claims that may be raised against the Controller. Unless a specific provision states otherwise, the limitation period is 6 years, and for claims concerning periodic benefits and claims related to conducting business activity – 3 years.
2.2. Where the basis for data processing is the performance of a contract, the User’s and/or Customer’s personal data is processed by the Controller for as long as is necessary to perform the contract and, thereafter, for a period corresponding to the limitation period for claims. Unless a specific provision states otherwise, the limitation period is six years, and for claims concerning periodic benefits and claims related to conducting business activity – 3 years.

 

§7.
Automated decisions based on personal data, including profiling.

Users’ personal data is not subject to automated decision-making, including profiling.

 

§8.
Information about cookies

1. Our Website uses cookies.
2. Cookies are small text files stored on Users’ devices while browsing the Website. They are used to facilitate the use of the Website, reduce its loading time, remember preferences selected by the User and enable the analysis of Users’ traffic and behaviour.
3. Cookies may be persistent or temporary (session cookies). Persistent cookies are stored on the User’s device for a specified period or until they are deleted by the User. Temporary cookies are deleted when the browser is closed.
4. The Controller uses various types of cookies:

a) Session cookies, for which the stored information is deleted from the device’s memory after the relevant browser session ends or the computer is switched off. The session cookie mechanism does not allow any personal data or confidential information to be retrieved from Users’ computers.
b) Persistent cookies, which are stored in the memory of the User’s end device and remain there until they are deleted or expire. The persistent cookie mechanism does not allow any personal data or confidential information to be retrieved from the User’s computer.
c) Technical cookies, which are necessary for the proper functioning of the Website. They make it possible to maintain the User’s session, operate forms, remember preferences and ensure the security of the Website. These cookies are used by default, which means they are saved on your computer or smartphone (in accordance with Article 173(3) of the Telecommunications Law) when you access our Website.
d) Third-party cookies, which are used by external analytical and advertising tools and for integration with social media.
e) Analytical cookies, which are used to collect information about how Users use the Website, such as the number of visits, pages visited, time spent on the Website or the source of traffic. The data obtained helps to analyse and optimise the Website, improve its functioning and adapt content to Users’ needs.
f) Marketing / advertising cookies, which enable the personalisation of advertisements and the performance of remarketing activities tailored to Users’ interests and preferences. They are also used to measure the effectiveness of advertising campaigns, create anonymous statistics and optimise advertising content.

5. The cookie mechanism is safe for the computers of Users visiting the Website. In particular, it is not possible for viruses or other unwanted or malicious software to enter Users’ computers in this manner. In addition, Users may restrict or disable cookies’ access to their computers. If this option is used, it will still be possible to use the Website, except for functions which, by their nature, require cookies.

 

§9.
Why do we use cookies?

1. Cookies can significantly improve the user experience on the Website.
2. The Controller uses cookies in order to display on the Website a map showing the location of the Controller’s office, using the maps.google.com online service (external cookie controller: Google Inc., with its registered office in the USA).
3. Cookies make it possible to adapt displayed content to the User’s preferences and interests, making the Website more attractive and useful.
4. The cookie mechanism may remember settings selected by the User, such as language, layout or colour scheme, which enables faster and more convenient use of the Website.
5. Cookies enable the Website to track the User’s activity across various subpages, making it easy to return to recently visited sections or continue unfinished activities, such as completing forms.
6. Cookies may be used to analyse Users’ traffic and behaviour on the Website, which helps optimise its performance and provide high-quality content.

§13.
Consent to the installation of cookies

If the User selects the “I accept” option, this will mean that they accept all cookies placed on the Website and confirm that they have read the information about cookies and the purposes for which they are used, as well as the circumstances in which data collected using cookies may be transferred to our partners.
2. Please remember that your consent is not required for essential cookies, as cookies of this type ensure the full and uninterrupted functioning of our Website. These cookies are exempt from the requirement to obtain the User’s consent in accordance with Article 173(3) of the Telecommunications Law.

§14.
Users’ rights

In connection with the processing of personal data, Users have the following rights:
1. Right to withdraw consent – legal basis: Article 7(3) of the GDPR.

1.1. The User has the right to withdraw any consent they have granted.
1.2. The withdrawal of consent takes effect from the moment the consent is withdrawn.
1.3. The withdrawal of consent does not affect processing lawfully carried out by the Controller before its withdrawal.
1.4. The withdrawal of consent does not entail any negative consequences for the User, but it may prevent further use of services or functionalities that the Controller may lawfully provide only with consent.

2. Right to object to data processing – legal basis: Article 21 of the GDPR.

2.1. The User has the right to object at any time, on grounds relating to their particular situation, to the processing of their personal data, including profiling, where the Controller processes their data on the basis of a legitimate interest, e.g. marketing the Controller’s products and services, compiling statistics on the use of individual Website functionalities, facilitating the use of the Website and conducting satisfaction surveys.
2.2. Unsubscribing by e-mail from receiving marketing communications concerning products or services will constitute the User’s objection to the processing of their personal data, including profiling, for these purposes.
2.3. If the User’s objection proves justified and the Controller has no other legal basis for processing personal data, the User’s personal data to which the objection relates will be deleted.

3. Right to erasure (“right to be forgotten”) – legal basis: Article 17 of the GDPR.

3.1. The User has the right to request the deletion of all or some of their personal data.
3.2. The User has the right to request the deletion of personal data if:

3.2.1. the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
3.2.2. they have withdrawn the relevant consent, to the extent that the personal data was processed on the basis of their consent;
3.2.3. they have objected to the use of their data for marketing purposes;
3.2.4. the personal data is processed unlawfully;
3.2.5. the personal data must be erased in order to comply with a legal obligation under European Union law or the law of a Member State to which the Controller is subject;
3.2.6. the personal data was collected in connection with the provision of information society services.

3.3. Despite a request for the deletion of personal data in connection with an objection or the withdrawal of consent, the Controller may retain certain personal data to the extent that processing is necessary for the establishment, exercise or defence of claims, as well as for compliance with a legal obligation requiring processing under European Union law or the law of a Member State to which the Controller is subject. This applies in particular to personal data including: first name, surname and e-mail address, which is retained for the purpose of examining complaints and claims connected with the use of the Controller’s services, as well as the residential address/correspondence address and order number, which is retained for the purpose of examining complaints and claims connected with concluded sales contracts or the provision of services.

4. Right to restriction of data processing – legal basis: Article 18 of the GDPR.

4.1. The User has the right to request the restriction of the processing of their personal data. Until the request has been considered, submitting such a request prevents the use of specific functionalities or services where such use involves the processing of data covered by the request. The Controller will also refrain from sending any communications, including marketing communications.
4.2. The User has the right to request the restriction of the use of personal data in the following cases:

4.2.1. where the User contests the accuracy of their personal data – in such a case, the Controller restricts its use for the period required to verify the accuracy of the data, but no longer than seven days;
4.2.2. where the processing of data is unlawful and, instead of deleting the data, the User requests the restriction of its use;
4.2.3. where the personal data is no longer necessary for the purposes for which it was collected or used, but is required by the User for the establishment, exercise or defence of claims;
4.2.4. where the User has objected to the use of their data – in such a case, the restriction applies for the period required to determine whether – due to the particular situation – the protection of the User’s interests, rights and freedoms overrides the interests pursued by the Controller in processing the User’s personal data.

5. Right of access to data – legal basis: Article 15 of the GDPR.

5.1. The User has the right to obtain confirmation from the Controller as to whether personal data is being processed and, where that is the case, the User has the right to:

5.1.1. obtain access to their personal data;
5.1.2. obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients of the data, the envisaged period for which the User’s data will be stored or the criteria used to determine that period (where it is not possible to specify the envisaged data processing period), the User’s rights under the GDPR and the right to lodge a complaint with a supervisory authority, the source of the data, automated decision-making, including profiling, and the safeguards used in connection with transferring the data outside the European Union;
5.1.3. obtain a copy of their personal data.

6. Right to rectification of data – legal basis: Article 16 of the GDPR.

6.1. The User has the right to request that the Controller promptly rectify inaccurate personal data concerning them. Taking into account the purposes of the processing, the User whose data is concerned has the right to request that incomplete personal data be completed, including by providing a supplementary statement and sending the request to the e-mail address specified in §1 of the Privacy and Cookies Policy.

7. Right to data portability – legal basis: Article 20 of the GDPR.

7.1. The User has the right to receive the personal data they have provided to the Controller and subsequently transmit it to another personal data controller selected by them. The User also has the right to request that the personal data be transmitted by the Controller directly to such a controller, where technically feasible. In such a case, the Controller will transmit the User’s personal data in the form of a csv file, which is a commonly used, machine-readable format that enables the received data to be transmitted to another personal data controller.
7.2. Where the User exercises any of the above rights, the Controller fulfils the request or refuses to fulfil it without undue delay and no later than within one month of receiving it. However, where – due to the complexity of the request or the number of requests – the Controller is unable to fulfil the request within one month, it will fulfil it within a further two months, having first informed the User, within one month of receiving the request, of the intended extension and the reasons for it.

8. The User may submit complaints, questions and requests to the Controller concerning the processing of their personal data and the exercise of their rights.
9. The User has the right to lodge a complaint with the President of the Personal Data Protection Office (at the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).

§15.
Changes to the Privacy and Cookies Policy

The Privacy and Cookies Policy may be amended, and the Controller is not obliged to provide notification of such amendments. Questions concerning the Privacy and Cookies Policy should be sent to: info@accurategroup.pl.
